National Standard Application Forms and Statutory Requirement Validation Help Sheets
From 6th April 2008, Communities and Local Government in conjunction with the Planning Portal will be rolling out the National Standard Application form known as 1APP. The national application forms will become mandatory on 6th May 2008
Provisions set out in Article 4E of the amended General Development Procedure Order (GDPO) introduce a standard planning application form published by the Secretary of State for planning permission and associated consents. The standard planning application form (1APP) will replace all existing types of planning application forms (except minerals) within England. It will be possible to use the new form to submit applications on paper, but the full benefits of standardisation will only be realised through its use as part of the electronically based process through the Planning Portal website at: www.planningportal.gov.uk.
The standard application form will become mandatory on the 6th May 2008 therefore any application submitted on any other application form will be rejected and made invalid for not being submitted on the National Standard Application Form.

Online Submission
Walsall Council encourages the use of the Planning Portal and we urge agents and applicants to submit their planning applications online. You can upload drawings, fill out the interactive National Standard Application and pay for your application online using the Planning Portal. In order to assess whether Planning Services is meeting the needs of all our customers it is important that we ask you a few questions about yourself prior to submitting your planning application on-line. It is not mandatory that you complete the form and it will not form part of or affect the outcome of your planning application, it will however enable us to obtain a greater understanding of all types of customers accessing the planning service and to identify where improvements are required. Your answers will be completely confidential and will only be used to monitor the Planning Service.

Fee exemptions and Concessions
The Regulations make a number of exemptions and concessions in respect of fees payable for planning applications and applications for approval of reserved matters.

Ownership certificates
Ownership certificates are included with the national application forms
- If the applicant is the owner of the site then Certificate A must be completed.
- If the applicant is not the owner of the site and you know who owns the site then Certificate B must be completed together with “Notice under Article 6 of application for Planning Permission”. The notice (Notice under Article 6) must then be served on the owner.
- Certificate C should be completed if there is more than one owner and you know some but not all of the owners of the site.
- Certificate D should be completed if you do not know any of the owner(s) of the site.
In all circumstances an Agricultural Holdings Certificate must be completed.
Fees for the Discharge of Planning Conditions (Including Requests that Conditions have been complied with)
The Town and Country Planning (Fees for Applications and Deemed Applications) (Amendment) (England) Regulations 2008
The Government has introduced new fees from 6th April 2008 for requests to a local planning authority for written confirmation of compliance with or to discharge a condition or conditions attached to a grant of planning permission. Full details can be seen in the Statutory Instrument 958 issued by the Government on 2nd April 2008 at www.opsi.gov.uk/legislation
A fee is now payable where a written request is made for the discharge or confirmation of compliance of one or more conditions on the same granted permission. The fee is payable per request and not per condition. The fee chargeable by the authority is £85 per request (or £25 where the related granted permission was for extending or altering a dwellinghouse or other development within the curtilage of a dwellinghouse). The appropriate fee must be paid when the request is made, and cannot be received retrospectively. Requests to discharge planning conditions or to confirm they have been complied with that are received without the appropriate fee will be returned unanswered. The request, identifying the granted permission and the conditions concerned (it does not matter when the permission was granted), should be submitted using the new application form which is available for you to submit and pay for your application online via the Planning Portal website - Click here to go to Planning Portal link. The request can also be made in any written form but you must ensure that it is clear and legible as any missing information or omitted additional documents that are required to support the request will result in your request being deemed invalid.

Once your request has been accepted as being valid we will notify you by letter to acknowledge receipt and to provide you with contact details of the allocated Case Officer whom you can contact with any queries you may have during the determination period.
The Government requires authorities to deal with all requests within 8 weeks and fees are refundable if no response is sent within 12 weeks from the date of receipt. There is no ‘free go’ if the Council decides that information submitted is not sufficient for a discharge of a condition or conditions. For larger developments where ongoing discussions and correspondence are necessary the Council will take a view as to whether a new fee is applicable dependent upon the amount of additional information required/submitted.
