Can I smoke in my own home?

Yes, even if people are visiting your home to undertake the following:

  • to provide personal care for a person living in the dwelling;
  • to assist with the domestic work of the household in the dwelling;
  • to maintain the structure or fabric of the dwelling; or
  • to install, maintain or remove any service provided to the dwelling for the benefit of persons living in it.

You may however, like to come to an agreement with the person working in your home about where and when smoking can take place.

However, your home must be smoke free if:

  • you are self-employed and work from home; and
  • Your home is also used as a place of work by other people who do not normally live there or is visited by members of the public in connection with the work or business carried on there.

Therefore, only self-employed people who work alone at home and do not require visits from members of the public are exempt from the smoke free legislation.
