Revised draft Statement of Licensing Policy (Consultation)
Under the Licensing Act 2003, we as the Licensing Authority, are required to produce a Statement of Licensing Policy, which sets out how we have interpreted the Act and the basis on which decisions are to be made, every three years.
The existing policy will require revising during 2010 in order for it to take effect from 7 January 2011 when the next three year cycle begins.
From 1 July 2010 to 20 September 2010 we are consulting on our draft revised Statement of Licensing Policy.
Your views are important in allowing us to reach a fair and proportionate Licensing Policy and we hope that you will be able to consider the draft document and offer any comments that you may have on it.

The new revised policy will be effective from 7 January 2011.
Current Licensing Policy
Section 5 of the Licensing Act 2003 requires that Walsall Council hereafter known as the Licensing Authority prepares and publishes a statement of its licensing policy every three years. This policy will be produced in compliance with the Licensing Act 2003 and subordinate legislation and guidance issued by the government. The aim of the policy is to ensure, fairness, clarity, and consistency, equality of treatment and proportionality in the approach to be adopted by the licensing authority in determining licensing applications.

Before determining its revised policy the licensing authority must also consult with the following:
- Chief officer of Police for the area
- Fire and rescue authority for the area
- Persons/bodies representative of local holders of premises licence
- Persons/bodies representatuve of local holders of club premises certificates
- Persons/bodies representative of local holders of personal licences
- Persons/bodies representative of business and residents in its area
