Public register of contaminated land

Walsall Council is required to keep a "Public Register"* that is readily available to anyone with an interest in the land, or any land that it has “determined” as being “contaminated land”. The Register is intended to act as a full and permanent record, open for public inspection, of all regulatory action taken by the enforcing authority in respect of the remediation of contaminated land, and will include information about the condition of the land **

Walsall Council has not determined any sites as being “contaminated land” in accordance with the definition given in the Environmental Protection Act 1990 (as amended), subordinate regulations and statutory guidance.

Please note that the absence of an entry on the Register does not indicate that any parcel of land is clean or uncontaminated. A large proportion of the land in Walsall Council’s area has been contaminated to some degree by previous or current land uses however it is not entered on the Register because it is not considered to present a hazard to present land users or the environment or because insufficient information about its condition is available. The designation of any land can change to reflect additional information about its condition becoming available or changes to its use.

Pollution Control Contaminated Land Team has access to extensive records relating to land use history and contamination potential that can be made available to the public in accordance with The Environmental Information Regulations 2004.
