Contaminated land strategy
Matters relating to “contaminated land” are covered by Part IIA of the Environmental Protection Act 1990 (section 57 of the Environment Act, 1995). The statutory definition of contaminated land is particularly prescriptive and it is impossible to determine if any land is statutorily contaminated unless site specific data is available and an assessment of risk has been undertaken.
Under the provisions of Part IIA of the Environmental Protection Act 1990 the authority is obliged to investigate its borough for the presence of contaminated land. To this end Walsall has published a Contaminated Land Inspection Strategy (PDF 360KB) which meets the requirements of Regulation and Statutory Guidance.
At this stage the Authority is implementing the first stage of the strategy which involves the prioritisation of land in order to locate sites posing the most serious risk to human health. This will involve consideration of previous and present land uses, the likelihood of, or presence of contamination and the potential of the site to cause harm.
Currently Walsall is focusing attention upon considering situations where there is a current high sensitivity land use (residential with gardens, school playing fields, allotment gardens) established upon land that has previously been used for potentially contaminative activities.
