Scheme of delegations
The following categories of application for planning permission will be determined by the Committee unless expressly delegated in respect of a particular application:
Major applications
The approval of major applications is a decision that can only be made by the Development Control Committee. The Head of Planning and Building Control has a delegation to refuse applications which do not raise complex or delicate judgments, and fail to comply with national or local planning policy, providing that there is no significant community interest in support of the application.
Major applications are defined as being for:-
- 10 or more dwellings
- building(s) with 1000 sq metres or more floor space
- if it does not involve buildings, a site area over 0.5 ha
- new or extended mineral working or waste disposal proposals
Departure from the UDP
Applications that would depart from the UDP (requiring publicity) where they don't comply with national or local Planning policy and there is no significant community interest which would be contrary to the officers recommendation.
Statutory consultee objection
Applications where an objection is received from a statutory consultee (as defined in the General Permitted Development (Procedures) Order 1995 (as amended) and there is no significant community interest which would be contrary to the officer recommendation.
Walsall Council employee
Applications made by or on behalf of a member of the Council or a senior officer of the Council (defined for these purposes as any officer who holds a politically restricted post) or any officer employed within Planning Services.
Called in by a Councillor
Applications called in by a Councillor.
None compliance with the UDP
Applications that do not comply with the UDP and are recommended for approval.
Council owned land
Applications that include Council owned land where a disposal of that land would follow.
Significant Community Interest
Applications attracting significant community interest (ie. as evidenced by a high number of individual representations or a significant/large petition objecting to a development) which would be contrary to the officer recommendation.
